Man Sentenced in Apple Valley Marijuana Grow Operation
[July 23, 2008] Dakota County Attorney James Backstrom announced that Dung Anh Nguyen, age 35 of Bloomington, was sentenced today by Judge Rex Stacey to 86 months in prison in connection with a large marijuana grow operation in an Apple Valley residence. Nguyen was convicted by a jury on June 9, 2008 of one count of Attempted Controlled Substance Crime in the First Degree, one count of Controlled Substance Crime in the Third Degree, and one count of Controlled Substance Crime in the Fifth Degree. Backstrom said the sentence was a double upward departure from Minnesota Sentencing Guidelines based upon this crime involving a significantly large marijuana grow operation with a high degree of sophistication and planning. Nguyen was also fined $10,000 and ordered to pay restitution to HSBC Bank USA, the current holder of the mortgage on this home, for the extensive damages caused by this illegal marijuana growing operation, and to Dakota Electric for the theft of electrical power used in connection in with this illegal enterprise.
