Regulating Solid Waste

Dakota County regulates facilities that accept, manage, and dispose of solid wastes of every type through licensing, inspections, and enforcement. Dakota County works closely with the Minnesota Pollution Control Agency (MPCA) on regulation of solid waste facilities.

The requirements for licensing and management of wastes at solid waste facilities are in Ordinance No. 110 – Solid Waste Management.

Proposed amendments to ordinance
The Dakota County Environmental Management Department is proposing to amend Dakota County Ordinance No. 110 – Solid Waste Management. The proposed changes include:

  • Modification and addition of several definitions
  • Removal of the Ordinance section that provided an exemption to farmers to burn and bury solid wastes
  • Modifications to financial assurance requirements for solid waste facilities
  • Changes to how the Ordinance defines major modifications to solid waste facility operations
  • Establishment of additional requirements relating to how landfills may manage contaminated soils
  • Modifications to the prohibited wastes that landfills may and may not accept
  • A provision to allow landfills to recirculate leachate
  • Inclusion of additional license application requirements for energy recovery facilities
  • Modifications to requirements for scrap yards
  • Additional requirements for the investigation and remediation of nonconforming sites
  • Addition of a new section providing for the emergency waiver of standards in the event of a disaster

Solid waste is managed in the Twin City metropolitan area through a number of different processes and facilities. Six metro counties, Hennepin, Ramsey, Anoka, Washington, Carver, and Dakota Counties, comprise the Solid Waste Management Coordinating Board (SWMCB). Through SWMCB with the assistance of the MPCA, plans are made for integrated regional solid waste management to conserve resources and protect the environment.
