Dakota County Attorney James Backstrom announced that Krista Ann Muccio, age 44 of Inver Grove Heights, pled guilty today to one count of Communication with a Minor Describing Sexual Conduct (a felony) in connection with sending inappropriate photographs of herself and explicit messages to a 15-year-old male during November of 2014. At the time, Muccio was employed as a lunchroom assistant at the middle school in Inver Grove Heights.
This case was the subject of a pre-trial appeal in which Muccio through her attorney challenged the constitutionality of the statute creating this crime under the free speech rights guaranteed under the First Amendment of the United States Constitution. On March 8, 2017, the Minnesota Supreme Court determined that this law did not violate the Constitution as to the facts of this case.
Backstrom commented: "This statute was enacted for the important purpose of prohibiting sexually explicit speech directed at a child that is intended to cause sexual arousal. We are pleased to bring Krista Muccio to justice for violating this law."
Judge Kathryn Messerich ordered a pre-sentence investigation and set the sentencing for April 6, 2018 at 10:00 a.m. in Hastings.
