Dakota County Attorney Kathy Keena announced today that Riccardo Rashad Harvey, 26 of Burnsville, was charged* with a dangerous weapon violation (reckless discharge of a firearm) after a 17-year-old was injured by a bullet while sleeping.
In the early morning hours of March 30, officers responded to a report of a person with a gunshot wound at a multi-family residential unit in Burnsville. At the scene, officers found a 17-year-old grazed by a bullet and hole in the ceiling directly above the child's bed. A bullet was later located on the floor next to the bed.
According to the criminal complaint, officers contacted an occupant in a nearby apartment who indicated his son, Mr. Harvey, legally owned three firearms.
The officers obtained a search warrant and found two magazines for a handgun in Mr. Harvey's bedroom. One magazine appeared full, while the other was missing a round. Officers then placed a trajectory rod into the hole located in the child's ceiling where it led into the defendant's bedroom.
The victim received treatment for non-life-threatening injuries at a local hospital and was later released.
“Mr. Harvey's extreme negligence could have led to more serious injury of the victim or others," said Dakota County Attorney Kathy Keena. “The situation certainly could have been catastrophic."
Keena thanked the Burnsville Police Department for their investigation of this incident.
Bail was set in the amount of $100,000 without conditions ($20,000 with conditions) by Judge Tanya O'Brien. Mr. Harvey's next court appearance is scheduled for April 16, 2024, 9 a.m. in Hastings.
